How This Table Is Used in Court

The median income comparison (§ 707(b)(7)) is the first step of the Chapter 7 means test. Your gross monthly income, averaged over the six calendar months before filing, is annualized (×12) and compared to the figure in this table for your household size.

At or below the median: the presumption of abuse does not apply. You are not required to complete the full means test (Form 122A-2), though the court may still consider your actual financial situation.

Above the median: Form 122A-2 determines eligibility. Allowable IRS expense deductions are subtracted from income — you may still qualify for Chapter 7 even if your income exceeds the median threshold.

These figures update periodically. The U.S. Trustee Program publishes revised tables when Census Bureau data is updated. Always verify against the current UST table before filing.
